Why were they removed and not tried under the laws of the country where they were apprehended?
Good question. Perhaps at the time they were apprehended there was no "rule of law" in that country or facilities to hold them or any guarantee that they would be held for trial.

Yes, and I disagreed with his position on that.
It depends on the evidence they have against them, like any other suspect. But if after 5 years they still have not managed to make a case against them in a court where the accuser is also the prosecution,defence, judge and executioner, then the chances are there is not much of a case to begin with.
Maybe because they were engaged in military or military type actions against us and they really are POW's but we can't call them that because it is not a declared war therefore they call them "illegal combatants' because it is more politically correct.
They haven't actually committed any "crime" in the sense of the word they were just "on the other side" in a conflict we consider a "war" and we captured them but are reluctant to free them as we are afraid they will show back up on the battlefield against us.
In a declared war they would be considered POWs and would probably never be charged with any crime, they would just be held until the end of hostilities and then released back to their respective countries at the war's end like we did in WWI and WWII.
Perhaps their countries of origin are supporters of terror and it would make no sense to send them home.
Perhaps their home countries don't want them or won't take them or do not have the ability to incarcerate them or try them for anything.
Perhaps what we are doing is the more humane thing for them at this particular time in history. Perhaps returning them home would result in their immediate execution or life imprisonment when all they did was fight for their side in what is in all actuality a "war".

I have no idea what would happen to them but I do not want to give them the opportunity to take up arms against us so I say we leave them where they are until it is all over, which may well be never.

Over half the terror suspects have been released, as in there was not enough evidence or not dangerous enough to lock up. You guys are fucking nuts, you have no regard for the law, and you wonder why people hate America? Idiots like you guys is exactly the reason why there is violence. The only difference between you and Osama Bin Laden is the location in the world where you are born.

But I do have a high regard for the law and I don't care if people hate America because I know that America is the greatest Country in the world and without "America" there would be no peace, anywhere. "America" is the glue that holds the entire world together.

Due process my ass, if there was a shred of evidence against them they would have been tried, after all OBL driver was tried for driving OBL. Should we try the driver of Bush for driving a war criminal or the pilot of airforce one?
Sure, why not? Under your reasoning they are as guilty as Bush for whatever you think Bush has done.
I actually think that there is a big difference between the various Secret Service Agents that drive Bush around and the various pilots of Air Force One compared to Bin Laden's driver.
The guys that chauffer Bush around are the same guys, usually, that chauffered the previous President around and will probably be the same guys that will chauffer Obama around.
They don't give a shit who the president is nor do they necessarily agree or disagree with his politics. It is their job and they will do it the best they can under whatever circumstances they are dealt.
Their lives do not depend on whether or not they agree and support the President. Their careers may matter but not their lives.
I like to think that they would be our first line of defense against a President that would overthrow our Government and Constitution.
Bin Laden did not, nor did he ever have, the luxury of being able to "assume" his driver or anyone else would protect him at all costs.
Our President can and does make that assumption and he damn well should be able to.
Perhaps that is what the courts need to decide?

Do we have the right to hold them or should they be released?
Are they criminals, illegal combatants, POWs, or people that just happened to be in the wrong place at the wrong time?
Are they entitled to a trial by their peers and where do we get their peers, from the battlefield?
Are they even entitled to a trial?
I don't think the Courts have a clue what it is they are supposed to decide and what if any laws apply to these people. This whole thing is something beyond and previous experience we have ever had or anyone else in the world has ever had therefore we are making it up as we go along and we are trying to be fair but sometimes that is not possible.
The courts should decide if there is a case against them.
A case of what?
A criminal case?
A civil case?
A war crime?
Are they combatants or POWS?
Did they or did they not participate in military actions against the US?
Are they "terrorists" or just confused youth?
Did they take up arms against their own country or just the US?
Are they traitors to their own countries?
Who the hell are they?
Are they mercenaries or soldiers?
What do you mean by a case against them? I don't think we can equat them to our normal criminal justice statutes.
What criteria should we use and wouldn't it be a good idea for everyone to agree as what the criteria will be BEFORE we decide to give them their so called day in court.

Those that want them to have a trial may have a point, let them face a jury and if the jury is anything like those responding to this question than I think they would be in deep doo doo seeing as how the votes are 224 to 96 for not being allowed out of jail on bond.
